A CHARTER ORDINANCE AMENDING Section 1-113 OF THE 1988 CODE OF THE CITY OF CHERRYVALE, EXEMPTING THE CITY OF CHERRYVALE, KANSAS FROM K.S.A. 14-1403 and REPEALING ORDINANCE 96-4111.

Whereas K.S.A. 14-1403 provides that the Mayor and one Commissioner shall have power to call a special meeting of the Governing Body; and

Whereas it is a violation of the Kansas Open Meetings Act for a quorum of the Governing Body to attend a prearranged meeting and it is the policy of the City of Cherryvale, Kansas to follow the directives of the Kansas Open Meetings Act.

NOW THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF CHERRYVALE:

SECTION 1: SPECIAL MEETINGS. Section 1-113 of the 1988 Code of the City of Cherryvale, Kansas is hereby amended to read as follows:

1-113. SPECIAL MEETINGS. The Mayor or any Commissioner shall have the power to call a special meeting of the Governing Body. The request for special meeting must be in writing and either have an agenda incorporated or attached to the request for special meeting. No business shall be transacted at the special meeting except that mentioned in the agenda/notice of special meeting. All action of the Governing Body shall be entered upon the journal by the City Clerk.

SECTION 2: EXEMPT. The City of Cherryvale, Kansas shall be exempt from K.S.A. 14-1403.
