(a)   It shall be unlawful for any person to engage in the business of peddler, canvasser, solicitor, transient merchant within the City without having first secured a license therefore as provided in this article.

(b)   EXEMPTIONS:

(1)   Any non-profit organization or agency or any chapter or division thereof;

(2)   Any organization or association connected with and recognized by a local school or school system; or

(3)   All persons who are residents of the City of Cherryvale, having resided in Cherryvale for a minimum of thirty (30) days.

(a)   Application for a license under this article shall be made to the City Clerk and applicants shall state thereon the name of the person desiring the license; the permanent address of the applicant; the description and number of vehicles intended to be operated; the kind of merchandise to be sold; and such other additional information as may be deemed necessary.

(b)   The license fee for a peddler, canvasser, solicitor, transient vendor or transient merchant shall be Fifty Dollars ($50.00) per year.

(c)   A separate license shall be issued to each person licensed under the provisions of this article, which license shall be conspicuously displayed by the licensee. Every license shall have the license in the licensee’s possession at all times the licensee is engaging in business, and display the license to any person upon request, and if any licensee sells, offers or exposes for sale any goods, wares or merchandise from a wagon, cart, truck, automobile or any other vehicle, the license shall-be posted in a conspicuous place upon the vehicle.

The following words and phrases, when used in this article, shall have meanings respectively ascribed to them:

(a)   PEDDLER shall mean a person who sells tangible commodities from house to house, place to place, store to store, or on the streets or in any public place; or one whose sales are not made from one established spot.

(b)   SOLICITOR  OR CANVASSER shall mean a person who takes orders for future deliveries, or for intangible services, or solicits subscriptions, in public places or from house to house, place to place and not from an established place on private premises.

(c)   TRANSIENT VENDOR OR TRANSIENT MERCHANT shall mean a person who sells commodities from private premises but remain at one place for temporary periods only.

(a)   STREET SALES. No person shall ply their vocation on any street, sidewalk, park, parkway or in any other public place, unless it so specifies on the license that doing business in such public places is permitted thereunder. No person so licensed shall block or obstruct in any mam1er any street, sidewalk, park, parkway or other public place.

(b)   PROTECTION OF LAWNS, YARDS. It shall be unlawful for any person engaging in peddling or soliciting to cut across or walk upon any lawn, front yard or courtyard, except upon sidewalks or walkways if the same are provided or upon a regularly established path where no sidewalk or walkway has been provided to the house or other building.

(c)   FRAUD. All persons licensed under the provisions of this ordinance shall certify that while doing business in the City, they will strictly comply with all ordinances of the City. Any licensee who shall be guilty of any fraud, cheating or misrepresentation, whether through themselves or through an employee, while doing business in the City shall be deemed guilty of a Class C misdemeanor.

Any person who shall engage in the business of peddler, canvasser, solicitor, transient vendor or transient merchant within the City without having first secured a license therefore as required by this article, shall be deemed guilty of a Class C misdemeanor. All persons who violate any other provisions of this article shall be deemed guilty of a Class C misdemeanor.
