CHAPTER XII. PUBLIC PROPERTYCHAPTER XII. PUBLIC PROPERTY\ARTICLE 4. CITY PASTURE AND BURNING GROUND

The City pasture burning ground (also known as the City dump for brush) shall be open for the disposal of brush and non-garbage and nontrash materials during the hours set by the City Administrator only for bona fide citizens of Cherryvale or the immediate vicinity.

All persons using the pasture burning ground for the disposal of burnable material other than trash or garbage shall pay the following fees for the benefit of using said grounds:

(a)   Residents of the City of Cherryvale using vehicles to haul said waste which vehicle hauling capacity does not exceed 3/4-ton weight limit, the fee is to be none.

(b)   Non-residents of the City of Cherryvale using vehicles to haul said waste which vehicle hauling capacity does not exceed 3/4-ton weight limit, the fee is to be $50.00.

(c)   Persons using a truck or other vehicle for hire to haul waste or any person using a truck or other vehicle which exceeds 3/4-ton hauling capacity, whether for hire or for personal hauling, the fee shall be $20.00. The City or its designated agent shall have the power to waive any for hire fee set forth herein for disposal of debris originating from property in the City of Cherryvale.

(d)   Fees shall be per each load whether said vehicle is carrying a full or partial load. Fees shall be charged for each entry into the pasture burning area.

(e)   In the event that the city pasture and burning ground is not open pursuant to regular schedule, the fees shall be double to allow compensation to the city to pay wages for employees to open the gate specially.

Only the following materials may be deposited in the City burning pasture: Trees, brush, leaves, and wood which is free of nails, glass and other material which is non-burnable. Under no circumstances shall any roofing materials, railroad ties, plastic items, garbage, or any waste other than that specified herein be deposited at the City pasture.

The caretaker shall be entitled to any and all salvageable articles which he may find in the pasture grounds and for which the City has not stored for future use.

Violation of this article is a class C misdemeanor.
