CHAPTER XVI. ZONING AND PLANNINGCHAPTER XVI. ZONING AND PLANNING\ARTICLE 1. PLANNING COMMISSION

There is hereby created and established the Cherryvale Planning Commission, under and by virtue of the provisions of Kansas Statutes Annotated 12-701 through 12-715, inclusive, and amendments thereto.

(K.S.A. 12-701 et seq.; Code 2001, 5-101)

(a)   The Cherryvale Planning Commission shall consist of five (5) members, to be appointed by the mayor of the city by and with the consent of the governing body. At least four (4) of the members shall be residents of the city and one (1) member may be a resident of the territory outside of the city, but within three (3) miles of the city limits, and all five (5) of whom shall be electors of the territory in which they shall respectively reside.

(b)   The members of this planning commission first appointed shall serve respectively for terms of one (1) year, two (2) years, and three (3) years, divided equally as possible among these terms, as ay be determined at the time of such first appointment; thereafter members shall be appointed for terms of three (3) years each.

(c)   Members may be removed for cause by the mayor and governing body upon written charges and after public hearing.  Vacancies shall be filled by appointment for the unexpired term only, and all members shall serve without pay.

The planning commission shall function in all things according to the laws of the State of Kansas, it shall make or cause to be made a comprehensive plan for the development of the city, which it shall cause to be adopted and certified to the governing body. The commission shall annually review the plan and make a report to the governing body on or before the first day of June of each year. The commission shall also prepare and recommend the adoption of a zoning ordinance to the governing body and shall function according to the laws of the State of Kansas in administering such zoning ordinance.

The planning commission shall fix by resolution the time and place at which it shall hold a regular monthly meeting. Special meetings may be held on call of the chairmen. A majority of the commission shall constitute a quorum for the transaction of business. The commission shall cause a proper record to be kept of its proceedings.

During January of each year members shall elect a chairman and vice chairman who shall serve for a one-year term. A secretary shall also be elected by the members for a one-year term, but need not be a member of the commission.

On or before the first Monday in July of each year the commission shall prepare and submit to the governing body its budget of expenditures for the ensuing budget year, itemizing the expenses and amounts and the purpose. The governing body shall thereupon consider said budget and make such allowances to the planning commission as it shall deem proper including funds for the employment of such employees or consultants as the governing body may authorize and provide and shall add the same to the general budget of the city.
